Attorney at law Joshua Francis has been granted leave to apply for judicial review after he was charged for certain offences earlier this year.
Judicial review is a procedure by which a court can review an administrative action by a public body and secure a declaration, order, or award.
Based on the nature of the matter and in keeping with the law, we are unable to disclose further details on the charges filed against Mr Francis.
His legal team filed an application for judicial review against the decision of the Director of Public Prosecutions, Police Commissioner, Chief Magistrate and the arresting officer in March 2016.
According to the application filed, the decision can be challenged on three main grounds; illegality, irrationality referred to as (“Wednesbury unreasonableness”) and procedural impropriety.
Justice Bernie Stephenson granted Francis leave to apply for judicial review within fourteen days from today Friday 24 June.
Justice Stephenson however refused Francis’ application for specific disclosure.
The charge has not been read to date as Francis had earlier obtained a stay of proceedings at the Magistrate’s Court.
